FBI & CIA FIGHT OVER HIGH-TECH PRIVATE SPIES The vagaries of U.S. legislation governing the production and sale of high-tech electronic eavesdropping -- and counter- eavesdropping -- equipment has finally hit the major press. Noted American and international counter-eavesdropping specialist, James A. Ross, who has often been asked by the courts to give expert advice on the question, has been issuing warnings on this situation for some time (INT, n. 55", n. 59 9 & n. 66 10. "Intelligence" has echoed these warnings. In June, we mentioned that Ross warned against a "Major Threat to State and Local Law Enforcement Capabilities" in eavesdropping and the fact that state and local law enforcement bodies had begun to find it difficult to "procure the latest in Title III equipment, i.e., equipment 'primarily useful for the surreptitious interception of ... communication." He stated that action is needed in Washington before "serious harm will be done to the abilities of state and local law enforcement to properly perform technical surveillance." The problem centers around the vagaries of a new federal reinterpretation of the Safe Streets Act of 1968" concerning non-federal law enforcement use of eavesdropping equipment. For almost thirty years, the law has been interpreted to mean that manufacturers or dealers who sell Title III equipment only to law enforcement agencies are "agents under contract to..." authorized law enforcement agencies. This means that if their customers were federal, state or local law enforcement organizations, they were operating legally when they designed, built and sold such equipment (INT, n. 62 5). But in 1991- 1992, several such businesses received threatening letters from the Federal Communications Commission (FCC). This "reinterpretation" of the law resulted in the May 1996 indictment of Gilbert Walz, 41, head of Tech Support Systems in Burlingame, California, and Jude Daggett, 43, Walz's partner, who were later released on bail. According to Ross, Walz and Daggett were recently arrested on "trumped-up charges" related to recent sales of equipment. It seems that the "Feds" want to get the message across that they are the sole authority and have a monopoly on high-tech eavesdropping equipment, and that they want to keep it that way. On 14 October, Walz's federal trial began in San Jose, California, and, according to the press, it "will shed light on the continuing traffic in sophisticated eavesdropping technologies", failing to mention anything about thirty years of non-federal use of such equipment by authorized law enforcement officials. The "troubling questions about personal privacy in the era of wireless communications" have more to do with the FBI trying to monopolize a market it does not control. The "New York Times" was honest enough to characterize the case as involving "a world in which the distinction between what is legal and what is not depends entirely on circumstances". Indeed, last year, a separate federal trial against Walz and Daggett for the illegal sale of equipment to Mexican officials was so sensitive that its was monitored by the NSA for reasons of national security, closed to the public and finally postponed. Walz admits that his clients include Mexico and foreign embassies in Washington, and court documents state that he has also sold equipment to government and intelligence agencies in Brazil, Italy, South Korea, Malaysia, Canada and the Philippines. But, according to Walz, he tried, in 1996, to ask federal prosecutors for a clear definition of the limits set by the law, but was told the authorities could not advise him. Nonetheless, Tech Support Systems obtained export licenses from the Commerce Department for some of its sales to private companies, such as one granted on 15 June 1993 for $103,000 from a private Italian firm for 20 "cellular phone monitoring systems allowing calls to and from target phone to be monitored within a single cell." According to Ross, "This is the only law I know of that a person doesn't know until he is indicted what the law actually covers." Moreover, the Walz trial won't help to clarify the law since a pretrial ruling by U.S. District Court Judge, James Ware, has classified part of the evidence for national security reasons. But, perhaps, this may all be a thirty-year old "turf war" between the FBI and the CIA. According to a former Tech Support Systems employee, up until Walz's arrest, the company made monthly reports on its foreign sales to CIA representatives. In this convoluted federal bureaucratic game of Monopoly, the FBI apparently wants the U.S. private security industry to understand that you play with the "Bureau", not with the "Agency", or "go straight to jail". --------------------------------------------- Intelligence, N. 69, 20 October 1997, p. 30 GREAT BRITAIN - Post-Cold War MI5 on Welfare. With the end of the Cold War, like all major internal security services, MI5 had to convert to the new "Big Three": Terrorism, Drugs and Organized Crime. As long as the IRA was active, MI5 had a "raison d'etre" and could justify its budget. But the IRA hasn't been cooperative and MI5 has been obliged to fall back on welfare. It will now be earning at least some of its money from Social Security by catching cheats and bring back illegally obtained welfare funds which will pay part of MI5's work. This follows a recent decision by MI5 boss, Stephen Lander, that "serious crime", as defined in the 1996 Security Services Act, also includes welfare fraud. Calling in MI5 for welfare fraud means two things. First, "hot lines" to denounce welfare fraud have not been that successful. Second, MI5 -- and its alter ego, the NCIS -- aren't overloaded with high priority work in other areas. --------------------------------------------- Intelligence, N. 69, 20 October 1997, p. 34 FRANCE LIBYA WANTS A "DEAL", JUST LIKE IRAN As if tension between France and the U.S. wasn't already high enough, following the recent signing of a $2 billion gas prospecting and production contract by Total with Iran (see our Frontpage article in the previous issue, "France - European Tug-of-War with U.S. Heats Up"; INT, n. 68 1), it looks like France, with European backing, is now "leaning" toward a similar "deal" with Libya. There is no question that Libya is currently pushing for such a deal, now that Iran has its deal. This "push" has been discreetly confirmed by French intelligence sources who informed "Intelligence" that two supposed brothers of Colonel Muammar Qaddafi, Hanibal and General Mohamad Qaddafi, secretly visited France from 30 September to 4 October. It seems that French DST internal security was aware of Gen. Mohamad's arrival in France and that French DGSE foreign intelligence was aware of Hanibal's presence in France, but it took a day or so for French intelligence to "exchange notes" and realize that both brothers were visiting Paris at the same time. Apparently Hanibal was traveling with a Qatar passport and staying at the Grand Hotel Intercontinental while doing some "shopping". His first request was apparently made "indirectly" -- not through official channels -- for 60,000 AK- 47 assault rifles and a certain number of armored 4x4 vehicles. The request was reportedly interpreted as a clear message -- "Libya will do business through France but doesn't want to buy French equipment" -- somewhat similar to the Iranian deal. France, of course, would have no interest in furnishing Libya with such equipment. The 4x4's would quickly be mounted with heavy machine guns, turning them into a favored African military item: the "battle wagon". With a few dozen of these and a few thousand AK-47's in trained hands, Chad and other close French allies in Africa would be in serious trouble. Apparently, Libya has been "beating the bush" in Africa and Europe to improve its image and offer assurance that neither French, nor British, interests would be harmed. Specifically, Libya has apparently "proven" to London and Paris that it is "calming down" in Africa. "Intelligence" mentioned last month the odd "security training" contract Libya signed with Gambia, a former British colony surrounded on three sides by Senegal, a former French colony (see, "Gambia - Watching Libyan Instructors"; INT, n. 65 46). This contract has been put forward as "proof" of Libya's good faith in Africa. Besides arms and other imported products, Libya would also like to get out of a "deal" with France, and Europe in general, some "slack" concerning the U.S.-British insistence that Libya was behind the destruction of Pan Am Flight 103 over Lockerbie, Scotland, on 21 December 1988. Most Europeans have been convinced that the bombing has more to do with radical Palestinian and Iranian elements than with Libya, but few have spoken up against the overbearing voice of Washington on the matter. It is therefore quite significant that, at this time, the only U.S. ally in this affair -- Great Britain -- prepared a major media report (BBC, 14 October) casting doubt on Libya's involvement in the Lockerbie attack. At the same time, the Lockerbie-Libya case is before the World Court in the Netherlands where Great Britain is urging Libya to accept an impartial trial in Scotland. According to several specialists, there is "the odor of a deal floating in the air." --------------------------------------------- Intelligence, N. 69, 20 October 1997, p. 37 GERMANY - Russian Crime As Domestic Politics. When Russian scare stories appear in the German press, it's usually time to discuss defense or intelligence budgets. But when the German press recently published information from a BND report showing that Russian FSB internal security has close ties with Russian organized crime, the target was local politics, but not budgets. Apparently conservative CDU Interior Minister, Manfred Kanther, during the party's recent Leipzig congress, stated he would force the liberal SPD to "get tough" on organized crime and pass new laws. A few scare stories about massive organized crime near the borders could only help the cause. Association between the FSB and organized crime is not new, and neither are BND reports on associations between foreign intelligence services, crime and political figures. What's new is the use of the reports for domestic politics. Last year when Chancellor Helmut Kohl visited Argentina, he carried with him a late 1980's BND report on drug operations associated with the family of President Menem. With the report, Kohl was able to effectively argue for greater Argentine cooperation in fighting international drug traffic. Another BND report on Saudia Arabia was a royal who's who dealing with drugs, prostitution and illegal arms which would be very helpful in "doing business" in that country. --------------------------------------------- Intelligence, N. 69, 20 October 1997, p. 40 SWITZERLAND - "Under the Wire" on Dirty Money. The OECD's Financial Action Task Force on Money Laundering (FATF) had a heavy item on the agenda of its recent annual meeting in Paris: the examination of the case of Switzerland and that country's continued lack of a law requiring reporting suspicious deposits. Current Swiss banking law "encourages" reporting such deposits but it is not illegal not to report them. In addition to this "heavy" item, there was a "heavy" agenda and the FATF meeting ended before the Swiss case could be examined. "Just barely under the wire" ... the Swiss are now putting through a second reading of a bill which would make reporting suspicious deposits legally binding. This means that when the Swiss case is at the top of the agenda for next year's FATF meeting, everything will be in order. --------------------------------------------- Intelligence, N. 69, 20 October 1997, p. 43 CUBA/U.S.A. - Reverse U.S. Justice on Blockade. Those who help the U.S. with its economic blockade of Cuba are to be rewarded, and those that don't, are to be tried, condemned and sent to prison. It was just the opposite in the case of Spanish business partners, Juan Torres Manzano and Javier Ferreiro, who were both tried in Miami recently. The latter pleaded guilty and turned state's witness against the former. But, on 15 October, a jury found Torres not guilty and he was released. Now, Ferreiro is awaiting sentencing to up to two years in prison for pleading guilty. Sometimes it pays to fight your case. --------------------------------------------- Intelligence, N. 69, 20 October 1997, p. 45 ISRAEL - No Mossad Record for Netanyahu. Since Mossad's botched assassination attempt in Jordan against Hamas leader, Khaled Meshal, several press reports -- and a few "specialists" -- have labeled the operation Mossad's "worst blunder in history". In political terms, the botched operation comes at the worst possible time for Prime Minister Binyamin Netanyahu, but in strict terms of intelligence, Mossad's worst failure was on 21 July 1973 in Lillehammer, Norway, when a Mossad hit squad, led by Mike Harari, murdered Ahmed Bouchiki, a Moroccan- born waiter who they mistook for Ali Hassan Salameh, the "Red Prince" of the Palestinian Black September organization. At least six of Harari's team, including Dan Aerbel, Sylvia Raphael (INT, n. 10 19) and Avraham Gehmer, were arrested by Norwegian police within 24 hours of the murder, which is still referred to, within the Israeli intelligence community, as "leyl-ha-mar" -- the night of bitterness (INT, n. 29 58). Mossad killed Bouchiki only because he looked like Salameh. The incident was exposed in a 1978 French book by Vincent Monteil, "Dossier Secret sur Israel - Le Terrorisme".
