This is the first time that the state of Nicaragua has accused a former president, something that has provoked a serious crisis in the Constitutionalist Liberal Party which has been governing the country since 1997. The charges of fraud and illegal association to commit fraud against Alemán, current president of the National Assembly, name seven important former officials involved in fraud against the state television network during his presidency. The special prosecutor, Alberto Novoa, who filed the charges in Managua's Second District Court, said that Alemán masterminded the diversion of about 1.5 million dollars in state funds. Novoa indicated that the former president elaborated the plan under the advise of former Mexican ambassador Ricardo Galán and also the Mexican national Alejandro Lopez Toledo. "Besides directing and controlling the execution of all actions necessary to divert the money, Alemán kept himself informed of all such events at all times." According to the solicitor, various institutions gave funds to Channel l6 to pay the Mexican TV Azteca for program contracts through Casco S.A. a firm not registered in Nicaragua. "The money did not register with the accounting controls of Channel 6" said Novoa in his charges against Alemán and the remaining former officials. The first secretary of the Assembly, René Herrera, said that the courts sent parliament a notice of process and a petition to lift the legal immunity that Alemán enjoys with two other deputies. The removal of a deputy's rights requires the 47 votes of approval in the parliament of 92 members. The charges were also drafted against David Castillo, former presidential secretary; Marta McCoy, former secretary of Communications and current deputy for the Central American Parliament. The solicitor's office also accused Esteban Duque, Aleman's former minister of Public Works; Salvador Quintanilla, president of the state-owned telephone company; and David Robleto, former director of the Institute of Telecommunications and Post Office. Roberto Duarte, Aleman's last secretary of Communications, Sidney Pratt, former director of Channel 6 and another two Nicaraguans are currently in prison for defrauding Channel 6. The court also ordered the arrest of former ambassador Galán and his compatriot, both of whom left the country before the current president, Enrique Bolaños, disclosed the fraud on March 11. Alemán is also being investigated by the General Comptroller for alleged omissions in a financial declaration that he presented at the end of his 5 years of government, January 10. Esta es la primera acusación del Estado nicaragüense contra un ex mandatario, en un caso que ha también ha provocado una grave crisis en el seno del Partido Liberal Constitucionalista (PLC), que gobierna el país desde 1997. Los cargos por fraude, peculado y asociación ilícita para delinquir interpuestos contra Alemán, actual presidente de la Asamblea Nacional, involucran a siete importantes ex funcionarios durante su gestión vinculados con un fraude a la cadena de televisión estatal. El procurador especial Alberto Novoa presentó la acusación al Juzgado Segundo del Distrito del Crimen de Managua y dijo que Alemán dirigió un presunto plan para desviar fondos estatales por alrededor de 1,5 millón de dólares. Novoa indicó que el ex presidente contó con la asesoría del ex embajador mexicano Ricardo Galán y el también mexicano Alejandro López Toledo, para la elaboración del plan. "Además de dirigir y controlar la ejecución de todas las acciones necesarias para la desviación del dinero, (Alemán) se mantuvo en todo momento informado de tales hechos", señaló Novoa en un escrito de acusación ante los tribunales. Según la procuraduría, varias instituciones inyectaron fondos al Canal 6 para pagar contrataciones de programación a la mexicana TV Azteca, por medio de la empresa Casco S.A., que no está registrada en Nicaragua. "El dinero no ingresó a los controles contables del Canal 6", dijo Novoa en su acusación oficial contra de Alemán y el resto de ex funcionarios. El primer secretario de la Asamblea, René Herrera, dijo que los tribunales enviaron al parlamento la notificación del proceso y una petición para levantar la inmunidad jurídica de que goza Alemán como legislador junto con otros dos diputados. Para desaforar a un diputado se requiere la aprobación de 47 votos en el parlamento de 92 escaños. Los cargos también fueron formulados contra el ex secretario de la Presidencia David Castillo, legislador de la Asamblea, y la ex secretaria de Comunicaciones y actual diputada en el Parlamento Centroamericano, Marta McCoy. La procuraduría acusó también al ex ministro de Hacienda de Alemán, Esteban Duque; al ex presidente de la telefónica estatal, Salvador Quintanilla; y al ex director del Instituto de Telecomunicaciones y Correos, David Robleto. Por el fraude al Canal 6 están encarcelados el último secretario de Comunicaciones de Alemán, Roberto Duarte; el ex director del Canal 6, Sidney Pratt, y otros dos nicaragüenses. El Juzgado Segundo del Crimen también ordenó la detención del ex embajador Galán y su compatriota, quienes salieron del país antes de que el actual presidente, Enrique Bolaños, revelara el fraude el 11 de marzo.
